1. Agreement to These Terms
These Terms of Service ("Terms") govern your use of evomicrotech.com and the services provided by EvoMicroTech LLC ("EvoMicroTech," "we," "us," or "our"), a Georgia limited liability company. By using our website or purchasing any service, you agree to these Terms. If you sign a Service Agreement, Statement of Work, or Order Form with us, that signed agreement controls where it conflicts with these Terms. Our services are offered to businesses only.
2. Our Services
EvoMicroTech provides business-to-business digital marketing, marketing automation, and AI implementation services. Our core offering is the Growth Engine, a seven-layer marketing system: Warm Leads by Intent, Visitor Intelligence, Automation Hub, Paid Acquisition, Social Autopilot, Search Visibility, and an optional B2B Closer layer. It is offered in three plans:
Done For You: we build, run, and optimize every layer each month.
Guided Implementation: we build the system and train your team to run it.
Enterprise: every layer, plus live event geofencing, streaming TV campaigns, multi-brand infrastructure, and custom AI development.
We also offer custom development under a separate Statement of Work, and digital products such as templates, playbooks, and snapshots. We may update or discontinue services; changes do not reduce services you have already paid for.
3. Fees and Billing
Each plan has a one-time Strategy & Build Fee and a recurring Monthly Fee, as shown on our website or your Order Form. Monthly Fees are billed in advance. By purchasing, you authorize us to charge your card or bank account for the Strategy & Build Fee, each Monthly Fee until you cancel, and any approved add-ons or third-party costs. Charges appear on your statement as EVOMICRO. All prices are in U.S. dollars and exclude taxes unless stated. If a payment fails and remains unpaid ten (10) days after notice, we may pause services until it is paid.
4. Minimum Term and Cancellation
Monthly Growth Engine plans have a minimum initial term of three (3) consecutive monthly billing periods. Cancelling before the minimum term ends may result in the early-cancellation fees set out in your Service Agreement. After month 3, plans continue month-to-month, and you may cancel at any time with written notice received at least ten (10) days before your next renewal date. Refunds and cancellations are governed by our Refund & Cancellation Policy.
5. Advertising Spend
Advertising spend is not included in any fee. By default, ad spend is billed directly to advertising accounts that you own and control, and we manage those accounts on your behalf. If you choose to deposit advertising funds with us instead, Section 6 of our Refund & Cancellation Policy applies.
6. Third-Party Platforms
Our services run on third-party platforms, including GoHighLevel and advertising, social, and search networks. Their terms apply to your use of them. We are not responsible for their outages, policy changes, account restrictions, or price changes.
7. Your Responsibilities
You agree to provide accurate information; give us timely access to the accounts, content, and approvals we need; hold the rights to any materials you supply; and use our services only for lawful products and lawful messaging, including obtaining any consent required to contact your leads. Delays caused by missing access or approvals extend our timelines.
8. SMS Messaging Terms
By providing your mobile number and opting in, you agree to receive marketing, promotional, account, and reminder text messages from EvoMicroTech. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time, or text STOP to 404 913 6109. Reply HELP for help, or email [email protected]. Carriers are not liable for delayed or undelivered messages. You must be 18 or older to opt in.
9. Intellectual Property
You keep all rights to your trademarks, content, and customer data. We keep all rights to our pre-existing tools, templates, workflows, SOPs, and know-how, and grant you a license to use those built into your deliverables for your own business. You may not copy or resell our website content or materials without our written permission.
10. Privacy
We handle personal data as described in our Privacy Policy.
11. No Guaranteed Results
Marketing results depend on factors outside our control, including your offer, pricing, market, budget, and platform algorithms. We do not guarantee any specific number of leads, sales, rankings, revenue, or return on ad spend.
12. Limitation of Liability
To the extent permitted by law, neither party is liable for indirect, incidental, consequential, or punitive damages, or for lost profits. Our total liability for any claim will not exceed the fees you paid us in the three (3) months before the claim arose.
13. Suspension and Termination
We may suspend or terminate services for non-payment, a chargeback filed without first contacting us, unlawful use, or a material breach of these Terms. On termination, you pay all amounts due through the termination date. On request, and once your account is paid in full, we will export your contact data and deliverables.
14. Disputes and Governing Law
Please contact us first so we can try to resolve any concern informally. These Terms are governed by the laws of the State of Georgia, and the state or federal courts in Fulton County, Georgia have exclusive jurisdiction.
15. Changes to These Terms
We may update these Terms by posting a new version on this page with a new effective date. The version in effect when you make a purchase governs that purchase.
